Where required, we may request information concerning the beneficial owners of a business customer for identity verification, regulatory compliance, fraud prevention, due diligence, or other lawful purposes. Beneficial ownership requirements have been established by the U.S. government in part to assist in preventing financial crimes. If you provide us with a mobile telephone number, we may use that number to communicate with you by SMS or text message regarding your application, financing opportunities, account, products, Services, offers, or related updates, subject to applicable consent requirements.

By providing a mobile number and consenting where required, you authorize BluePeak Funding to send applicable text messages to that number. Message and data rates may apply depending upon your wireless provider and plan.

You may opt out of applicable text communications by replying STOP as instructed in the message. After submitting a valid STOP request, you may receive a confirmation indicating that you have been unsubscribed.

Mobile information will not be shared with third parties or affiliates for their independent marketing or promotional purposes. Text-message originator opt-in information and consent data will not be shared with third parties for such purposes.

How We Safeguard Information

BluePeak Funding uses commercially reasonable administrative, technical, and organizational safeguards intended to protect personally identifiable information under our control against unauthorized access, misuse, loss, alteration, or destruction.

No security system, Internet transmission, or electronic storage method can be guaranteed to be completely secure. Accordingly, although we take reasonable measures designed to protect information, we cannot guarantee absolute security.

When Users authorize us to electronically access banking information instead of providing paper records, such access may be provided on a read-only basis where applicable. Read-only access does not permit us to alter or edit your bank account information. Our employees do not receive access to your online banking username and password through such read-only connections.

Sensitive information transmitted between Users and our Site may be protected through SSL or similar encrypted communication technologies.

Nevada law defines a “sale,” subject to applicable limitations and exceptions, as certain exchanges of covered information for monetary consideration.

Verifying California Privacy Requests

Before fulfilling certain privacy requests, BluePeak Funding may take reasonable steps to verify the identity of the individual making the request.

The degree of verification required may depend upon the nature and sensitivity of the requested Personal Information and the potential risk associated with unauthorized access, disclosure, deletion, or correction.

For requests involving categories of Personal Information, or deletion or correction requests involving information that is not sensitive and presents a relatively limited risk of harm, we may seek to verify at least two reliable data points previously provided to us.

For requests involving specific pieces of Personal Information or sensitive information presenting a greater risk of harm, we may require verification using at least three reliable pieces of previously provided information.

Where appropriate, we may also require a signed declaration under penalty of perjury confirming that the requester is the individual whose Personal Information is the subject of the request.

Information requested for verification may include:

• First and last name;
• Last four digits of a Social Security number;
• Date of birth; and
• Business name.

We will use verification information as permitted by applicable law and will respond to verified requests in accordance with applicable requirements.

Right to Opt Out of Sale or Sharing

California residents may have the right to direct BluePeak Funding not to sell or share their Personal Information as those terms are defined under California law.
